By accessing or using Kaoleads ("Service"), including our Chrome extension and web application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Kaoleads is a lead generation and data scraping tool that allows users to:

• Extract business information from Google Maps
• Scrape product data from supported e-commerce platforms
• Store, manage, and export lead data
• Access AI-powered insights and recommendations

3. Account Registration

To use our Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree to use our Service only for lawful purposes. You must NOT:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Use scraped data for spamming, harassment, or illegal activities
• Attempt to bypass rate limits or access restrictions
• Reverse engineer, decompile, or disassemble our software
• Share your account credentials with others
• Use automated tools to access our Service beyond normal extension usage
• Collect sensitive personal information without consent

5. Third-Party Websites

Our Service enables you to scrape data from third-party websites. You acknowledge that:

• You are responsible for complying with the terms of service of any website you scrape
• We do not guarantee the availability or accuracy of third-party website data
• Third-party websites may change their structure, which could affect scraping functionality
• You use scraped data at your own risk and responsibility

Important: Some websites prohibit automated data collection. It is your responsibility to review and comply with the terms of service of any website you scrape. Kaoleads is not responsible for any legal issues arising from your use of scraped data.

6. Subscription Plans and Payments

6.1 Pricing

We offer various subscription plans with different features and limits. Current pricing is available on our website. We reserve the right to change pricing with 30 days notice.

6.2 Free Trial

New users receive a 14-day free trial (or 21 days with a referral code). During the trial, you have access to limited features as specified on our pricing page.

6.3 Payment Terms

Payments are processed through GCash. Subscriptions are billed monthly. Your plan will automatically renew unless cancelled before the renewal date.

6.4 Refund Policy

We offer refunds on a case-by-case basis within 7 days of purchase if you have not exceeded 10% of your monthly lead limit. Contact support@kaoleads.com for refund requests.

7. Usage Limits

Each subscription plan includes specific limits on:

• Number of leads you can scrape per month
• Total leads storage capacity
• AI requests per month
• Email verification credits

Exceeding your limits will result in temporary restriction of scraping features until your limit resets or you upgrade your plan.

8. Referral Program

Our referral program allows you to earn bonus leads by inviting others:

• Referred users receive 7 extra trial days (21 days total)
• You receive 200 bonus leads when a referral makes their first payment
• Maximum of 2,000 bonus leads per month (10 referrals)
• Abuse of the referral system may result in account termination

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Kaoleads and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you scrape using our Service. However, you grant us a limited license to store and process this data as necessary to provide the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy or reliability of scraped data
• Uninterrupted or error-free operation
• Compatibility with third-party websites

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAOLEADS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use of scraped data
• Any actions taken by third-party websites against you

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Kaoleads, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Non-payment of subscription fees
• At our sole discretion with reasonable notice

You may cancel your account at any time through your dashboard or by contacting support. Upon termination, your access to the Service will cease, and your data may be deleted after 30 days.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the Philippines.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
